General terms and conditions

1. The warranty applies only to the product “Solar System – 40KW” (hereinafter as the “Product”), i.e. the panels and inverters of it and excludes installation defects.

 

2. The installation of the Product is performed by the Buyer or by a recommended third-party installation company to which the Buyer agrees.

 

3. The Product is delivered in 8 to 10 calendar weeks. In case of bad weather conditions, vis maior or other objective reasons that would prevent Oricon from delivering the Product to the Buyer, the deadline for delivering the Product can be extended up to 3 additional months.

The delivery of the Product will be provided without any additional compensations by the Buyer on the territory of the Republic of North Macedonia and will be provided by the Seller to the specified location requested by the Buyer.

 

4. For the purchase of the Product, the Buyer has one option:

To pay the entire amount in advance. For the sale of the Product, the Seller will issue an invoice to the Buyer.

 

5. This warranty is valid under the following conditions:

- the user must comply with the instructions for maintenance and the instructions for using the product;

- the product must be maintained in accordance with the maintenance instructions;

- all services and removal of deficiencies or defects (with exclusion of installation activities) to be performed by Oricon or Authorized Oricon service providers;

- all servicing and removal of deficiencies or defects should be performed using spare parts from Oricon or Authorized Oricon service providers;

- the defect of the product was not caused by the user who uses the product and;

- the product not to be damaged due to natural/weather disasters (floods, fires, electrical discharges/lightning, hail, etc.), theft, vandalism or improper installation;

 

6. Limitations and exclusions not covered by this warranty:

a. The parts and costs of regular maintenance of the product in accordance with the instructions for maintenance and with the instructions for use;

b. Parts of the product that were modified/repaired by an unauthorized person outside of the organization Authorized Oricon Service including the consequences of those modifications on other parts of the product;

c. The consequences of not respecting the safety signaling of the product;

d. The consequences of not following the instructions for maintenance and the instructions for using the product,

e. The consequences of external influences on the product, such as mechanical and chemical damage or dirt, regardless of the cause;

f. The consequences of force majeure or natural disasters (including, without limitation, lightning strike, fire, flood, electric shock, damage caused by too low or too high electric voltage, etc.);

g. Consequences caused to the product due to interventions by unauthorized persons, non-observance of the prescribed procedures and instructions for repairs/services, installation of non-original (replacement) parts or maintenance of the product outside the authorized service network of Oricon;

h. Consequences if the user did not report them immediately and did not enable the removal of defects when he noticed them and which were already obvious at the time of delivery or became obvious later;

i. The consequences and the malfunction that occurred due to an error or due to a deficiency in the system to which the product is connected.

 

7. Claims for malfunctions or defects resulting from:

- due to negligence and carelessness,

-from any foreign part/body in or on the damaged part of the product,

-freezing,

-misuse of these Commercial Warranty Terms,

- if the user did not allow or does not allow the removal or repair of the defect that was discovered by an authorized Oricon service technician.

 

8. In the event of a product defect, the repair must be carried out within a reasonable period of a maximum of 30 days.

The provider of the commercial warrantythe Seller in the event of a defect in the product covered by this commercial warranty shall bear the cost of spare parts as well as the labor costs associated with the repair, as well as the shipping costs of the repairer. The Buyer is obliged to enable access to the product and provide all the necessary conditions to be able to perform the service or the replacement of the part.

 

9. If it turns out that the user's complaint, i.e. the reported defect of the product is not covered by this commercial guarantee, the user will have to bear the costs specified under point 5.

 

10. If the product is not repaired within a reasonable time within the warranty period and upon the user's complaint, or if the product cannot be repaired due to the defect, the user can request replacement of the defective product with a new product of the same type, type and quality.

If the product is no longer produced at the time of the complaint, the specified replacement will be carried out with the delivery of a similar product.

The costs of replacing the defective product with a new, identical or similar product are borne by the warranty provider – the Seller.

 

11. The Buyer has rights from the responsibility for the material defects of the product based on the Law on Obligation Relations in relation to the seller, free of charge. This commercial warranty does not affect rights from liability for material defects.

 

12. All repairs, replacements, spare parts and work performed under this commercial warranty are warranted until the expiration of this commercial warranty.

 

13. This Warranty applies to Oricon products for which the following conditions are cumulatively met: the product must be purchased in the Republic of North Macedonia and put into operation on the territory of the Republic of North Macedonia by an Authorized Oricon Service in accordance with the provisions of these Terms for Commercial guarantee. If the Oricon product is used in any other way or outside the Republic of North Macedonia, this commercial warranty does not apply.

The law of the Republic of North Macedonia shall apply to all questions regarding this commercial guarantee. In case of dispute, the court in Skopje is competent.
